THE EVOLUTION OF THE INTEGRATED WATER SERVICE IN ITALY: ISSUES AND CURRENT PROBLEMS

Abstract Italiano: Il servizio idrico integrato è stata oggetto di molteplici interventi legislativi che ne hanno modificato l’organizzazione, la gestione e le modalità di affidamento del servizio. Le novità disposte dal d.l. 12.9.2014, n. 133 conv. in L. 11.11.2014, n. 164 incidono su numerosi e rilevanti aspetti che riguardano, da una parte, gli assetti istituzionali e organizzativi del settore (governance) e, dall’altra, gli interventi infrastrutturali, la tutela ambientale e la qualità del servizio reso all’utenza, anche in relazione al rispetto degli obblighi stabiliti dalla normativa europea. La sfida da affrontare, oggi, consiste nel bilanciare le opposte esigenze tra la protezione dei diritti fondamentali e il risparmio delle risorse pubbliche. Il Servizio Idrico Integrato, come stabilito dal legislatore nazionale e più volte confermato dalla Corte costituzionale, anche nelle recenti sentenze del 21.03.2012, n. 62, è un Servizio a rilevanza economica. Questo comporta che la tariffa e la relativa regolazione abbiano un ruolo determinante.
Abstract Inglese: The water service has been the subject of many legislative measures that have altered the organization, the management and the procedures for award of the service. The changes provided by D.L. 12/09/2014, n. 133 conv. into L. 11/11/2014, n. 164 affect many important aspects that concern, on the one hand, the institutional and organizational structure of the sector (governance) and on the other, the infrastructure works, environmental protection and quality of the service provided to users, relating also to the enforcement of obligations under EU law. The challenge today is to balance the conflicting demands between the protection of fundamental rights and savings of public resources. The Integrated Water Service, as established by law and repeatedly confirmed by the Constitutional Court, including the recent judgments of 21.03.2012, n. 62, is a service of economic importance. This means that the rate and its setting have a determinative role.
