L’ETERNO DILEMMA CIRCA LA DISTINZIONE FRA RIFIUTI O SOTTOPRODOTTI. IL CASO SPECIFICO DEI RESIDUI DI PRODUZIONE E L’INTERVENTO ESPLICATIVO DELLA SUPREMA CORTE (SENT. CASS. PEN. SENTENZA N. 40109/2015)
Abstract Italiano: Il sottoprodotto non necessita di essere sottoposto al trattamento di recupero, altrimenti non rivestirebbe le caratteristiche merceologiche e ambientali che lo connotano sin dall'origine, e che lo qualificano come tale, contrapponendolo e distinguendolo dal "rifiuto". Ma, al contempo, non è più richiesto, in modo rigoroso che il sottoprodotto sia utilizzato "tal quale" in quanto sono permessi trattamenti minimi, rientranti nella normale pratica industriale. Ove i residui della produzione industriale siano "ab origine" classificati da chi li produce come rifiuti, gli stessi devono ritenersi sottratti alla normativa derogatoria prevista per i sottoprodotti come definiti dall'art. 184-bis, T.U. ambiente, in quanto la classificazione operata dal produttore esprime quella volontà di disfarsi degli stessi idonea a qualificarli come "rifiuti" in base all'art. 183, comma primo, lett. a) del citato decreto.
Abstract Inglese: The byproduct recovery does not need to be treated, otherwise it wouldn’t has the environmental and sector characteristics that define from the outset, and that qualify it as such, contrasting it and distinguishing it from "waste". But, at the same time, it is no longer required, so strict that the byproduct is used equal because they allowed minimum pensions, within normal industrial practice, as identified above. Where residues of industrial production are "from the source" classified from those who produce them as waste, they must be subtracted derogatory legislation planned for byproducts as defined in art. 184-bis of Legislative Decree n. 152 April 3, 2006, since the classification made by the writer expresses that desire to get rid of those likely to qualify them as "waste", according to art. 183, first paragraph, lett. a) of the above mentioned Decree.
